Our Terms of Business
These are the standard terms for the provision of funeral services by W.Brindley’s Funeral Service Ltd having their registered address at 46 Market Street, Mottram, Hyde, SK14 6JG.
1) Arrangement Permissions
W.Brindley’s Funeral Service Limited will only deal with and executor, or the next of kin of the deceased. (i.e. an executor of a will if one is in place, the surviving spouse, their children, their parents, or any other blood relation if there is no other closer family member)
2) Estimates and Expenses
An estimate will be supplied at arrangement stage is for all services you have requested at the time of the initial arrangements. This will include our charges and all third-party charges, (disbursements), discussed with the funeral director at the time of the initial funeral arrangements. Any further charges due to any changes to the initial arrangement, will be given verbally. The final invoice will have a more accurate and detailed cost of services we have supplied.
3) Payment Arrangements
3.1) Once the estimate has been accepted and signed, we respectively request that a deposit is paid to us prior to the funeral. This deposit will be 100% of the disbursements that have been worked out at the time of the inital arrangements. This can be made paid using internet banking and our account details are :- Name on the Account – : Retracted Sort Code: Retracted. Account number: Retracted. The final invoice will then be produced the day following the funeral, or the Friday of the funeral taking place, should the day of the funeral fall on a Friday. The remaining balance will then become due within 7 days of the date of the invoice. If you have any issues meeting our payment terms, please do not hesitate to get in touch so that we can discusses further agreements with you.
3.2) All payments must be made in British Pound Sterling by BACS, cash (We do not accept commemorative coins of the realm.) or cheque. If the final invoice is not paid within the 7 days of the date of the invoice, interest will accrue on a monthly basis from the date of the funeral invoice, at a rate of 8% above the Bank of England's base rate. This will be compounded on the 1st of every month, until the date of the actual payment of the account is discharged in full, whether before or after judgement. If we have to recover our account by means of any form of recovery, all costs will be added to your final amount payable to ourselves. This recovery action may also affect your credit ratings should it be required to carry out this form of recovery. Our Collection Agents are Recoverable Solutions Limited to which all details of your account with us will be passed on to, in order to enforce.
3.3) All fees shown on the estimate are due 72 hours before the funeral should your choice of funeral arrangement be our Direct Funeral Option.
4) Cancellations
We reserve the right to terminate our services at any time if you fail to follow your obligations of these terms and conditions. If you wish to cancel your arrangements with W.Brindley’s Funeral Service after signing our agreement, this is to be done so in writing. We reserve the right to make any charges, for any services carried out to date and any disbursements we have paid out on your behalf, with which we cannot get a refunded.
5) Cooling-Off Period
The Consumer Contracts (Information, Cancellation and Additional Charges)Regulations 2013 may give you the right to terminate provision of our services in the cooling-off period of 14 days after you have agreed to engage our services, providing no services have taken place. In the event that you exercise the right to cancel our services during the cooling-off period, if you have received any goods or services from us during such period, you will be required to reimburse us for any incurred costs and expenses associated with provision of the goods or services during the cooling-off period. If your funeral has taken place within the 14 days cooling off period, then the full amount of the invoice will be payable.
6) Termination
The services may be terminated before the services are delivered: by us if you fail to honour your obligations under these terms, and by you communicating with us in writing, whether this be by email or post that you are terminating your instructions and engagement of the services. If we or you terminate the services you may, depending on the reasons for termination, at our discretion be asked to pay a reasonable sum based upon the services carried out up to the time of termination. Such amount will be advised to you in writing.
7) Additional Legal Requirements
7.1) Any inappropriate items found in a coffin during our final closing down procedure will be discreetly disposed of.
7.2) Any unclaimed items of clothing/effects will be discreetly disposed of after 7 days of the funeraltaking place, unless otherwise agreed with your funeral director. (This excludes any personal effect, to which will be returned see 7.3 below.)
7.3) Any items of Jewellery will be removed and placed into safe keeping and returned to the account holder only, on the day of the funeral. Unless written confirmation is obtained prior to the coffin being closed, for these effects to remain with your loved one.
8) Donations Procedure
8.1) Donation can be collected on your behalf at the time of the funeral taking place, via a locked donation box. Which will then be opened in the presence of the next of kin.
8.2) Upon collection of donations, all cash will be handed to the account holder only which is stated on our account. We will then require a signature to confirm the donations have been handed to our account holder (we will not handle any forms of cash donations on your behalf). It is then advised that payments can be made to your nominated charity online.
8.3) We are willing to deal with cheques and a list of the amounts and donators suppled to the next of kin, before cheques are sent to the relevant charity
8.4) INTERNET DONATION SITE – Internet donation sites (i.e. Memory Giving, Just Giving, Much Loved, etc) handle the administration of donations on your behalf and are, therefore, outside of the scope of this procedure.
9) Cremated Remains Policy
W.Brindley’s Funeral Service will collect Cremated Remains within a week after the Funeral Date, if it has been requested for us to do so. If you choice of funeral service is a Direct Cremation, then the ashes will be in our care in around 14 days after the funeral date. If we collect them, we will contact the family to advise that we now have the cremated remains with us. We will keep the cremated remains for a maximum of 2 years, if they are not collected within this time frame, we will arrange for them to be scatter at a place of remembrance ourselves
